Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Agent", "you", or "your") and HomeScore ("we", "us", or "our") governing your access to and use of the HomeScore platform, including the web application at app.homescore.io, the marketing site at homescore.io, the WordPress plugin, and any related services (collectively, the "Service").

By creating an account or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

HomeScore provides a lead generation platform for real estate agents. The Service includes:

• An embeddable home valuation widget for use on agent websites.
• A WordPress plugin for integrating the widget on WordPress sites.
• Automated home valuation reports (AVM-powered) delivered by email to homeowners.
• A lead management dashboard displaying homeowner submissions.
• Valuation history tracking.
• Custom agent landing pages (Pro plan).

Valuations are generated using third-party automated valuation models (AVMs) and are estimates only. HomeScore does not guarantee the accuracy of any valuation figure. Estimates should not be used as appraisals or substitutes for professional real estate advice.

3. Account Registration

To use the Service, you must register for an account. You agree to:

• Provide accurate and complete registration information.
• Keep your account credentials confidential and not share them with others.
• Notify us promptly at hello@homescore.io of any unauthorized access to your account.
• Be responsible for all activity that occurs under your account.

You must be at least 18 years old and legally authorized to operate as a real estate agent or broker in your jurisdiction to use the Service.

4. Plans, Billing, and Credits

4.1 Plans

HomeScore offers a Free plan (10 valuation credits/month) and a Pro plan ($29/month, 50 valuation credits/month). Plan details, pricing, and included features are as described on the pricing page at the time of your subscription and may be updated with notice.

4.2 Valuation credits

Each homeowner submission that generates a valuation report consumes one credit. Credits reset monthly on your billing date. Unused credits do not roll over. Booster packs (15 credits for $10, 30 credits for $20) may be purchased at any time and are consumed before your monthly credits.

4.3 Billing

Pro plan subscriptions are billed monthly in advance. All payments are processed via Stripe. By providing payment information, you authorize us to charge the applicable fees. Prices are in USD and exclude any applicable taxes.

4.4 Refunds

Monthly subscription fees are non-refundable. If you cancel your Pro subscription, you retain access until the end of your current billing period. Booster pack purchases are non-refundable once credits have been used.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable real estate regulations.
• Misrepresent HomeScore valuations as professional appraisals or guarantees of property value.
• Collect homeowner data through the widget without clearly disclosing your identity as a real estate agent.
• Spam or harass homeowners who submit through your widget.
• Reverse engineer, decompile, or attempt to extract the source code of the Service.
• Resell, sublicense, or white-label the Service without our written consent.
• Use the Service to build a competing product or service.
• Attempt to circumvent credit limits through automated or fraudulent submissions.
• Upload or transmit malicious code, viruses, or any content that could harm the Service or other users.

6. Homeowner Data and Your Responsibilities

As an agent using HomeScore, you are responsible for ensuring that your use of homeowner data collected via the widget complies with applicable privacy laws, including but not limited to CAN-SPAM, CCPA, and any state-level real estate data regulations.

You agree to:

• Only contact homeowners for legitimate real estate purposes related to their valuation request.
• Honor opt-out requests from homeowners promptly.
• Not sell or transfer homeowner contact information to third parties without consent.
• Maintain a privacy policy on your own website disclosing how you use the data collected via the widget.

7. Intellectual Property

The Service, including its design, software, trademarks, and content, is owned by HomeScore and protected by intellectual property laws. These Terms do not transfer any ownership rights to you.

You retain ownership of any content you upload (such as your logo or branding assets). By uploading content, you grant us a limited license to display it within the Service on your behalf.

The HomeScore name, logo, and related marks are trademarks of HomeScore. You may not use our trademarks without our prior written consent.

8. Disclaimer of Warranties

Important

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy of valuations, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses.

AVM valuations are algorithmic estimates based on publicly available data. They are not professional appraisals and may differ materially from actual market value. HomeScore makes no representations regarding the accuracy or completeness of any valuation.

9. Limitation of Liability

To the maximum extent permitted by applicable law, HomeScore and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including lost profits, lost leads, or data loss, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from or related to the Service shall not exceed the greater of (a) the total fees paid by you in the 3 months preceding the claim or (b) $100 USD.

10. Indemnification

You agree to indemnify, defend, and hold harmless HomeScore and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your breach of applicable law; or (d) any claim by a homeowner or third party related to your use of the lead data collected via HomeScore.

11. Termination

You may cancel your account at any time from your account settings or by contacting hello@homescore.io.

We reserve the right to suspend or terminate your account immediately, without notice, if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to other users, third parties, or the integrity of the Service.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including Sections 7, 8, 9, 10, and 13) will survive.

12. Modifications to Service and Terms

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We may also update these Terms from time to time. When we do, we will update the "Last updated" date and, for material changes, notify you by email. Your continued use after changes are posted constitutes acceptance of the updated Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. You waive any right to participate in class action litigation or class-wide arbitration.
